In the drafting of a retail lease, there is an obligation for both parties to ‘cooperate’. Very often a clause to this effect may not be in the lease but the obligation is certainly still there. In this article, John Morrison looks at the extent of the implied obligation. The concept of cooperation between parties is all about teamwork: working together in unity, collaboration, and give-and-take.
